I remember reading about the original case in Australia. There were many protests at the time because the system could be easily abused. Recent cases in the UK have shown that if a legal process can be abused it will be abused. For example, what is to stop claimants issuing purely spurious summonses of which the 'recipient' has no knowledge? (Debt collection agencies are particularly adept at this as I found out recently). I know personally of a man in his early 60s whose marriage, job, physical and mental health was wrecked by a false allegation by a rogue solicitor. Yet the latter did nothing illegal so will never face a criminal prosecution.
