Stoke noodle bar still operating despite being refused permission TWICE

A noodle bar in Coventry has vowed to stay open despite having planning permission refused for the second time.

Chop and Wok on Humber Avenue, has been told it does not have permission from the council to operate as a hot food takeaway, which it has been doing for several months.

The eatery was first refused planning permission on August 21, 2018, but opened for business 10 days later.

The council revealed that they were investigating the takeaway, but suspended it after Chop and Wok submitted a revised planning application.

Unfortunately for them, their new planning application has also been refused - but the owners have no plans to close down at this time.

Chop and Wok's first application for their Humber Avenue site - their first outside of Birmingham, was submitted on June 22, documenting their plans to transform the former newsagents into a fast food outlet - creating three jobs.

However, Coventry City Council's planning officer involved in the case had a number of concerns in regards to the application, and ultimately recommended that the application be refused.

Following news of the second refused application, Chop and Wok revealed they are considering their options, but in the meantime, they have no intention of closing their Coventry takeaway.

A spokesperson for Chop and Wok said: "We have received confirmation that the application was refused, despite reducing our opening hours to match the shops opposite and providing a new extraction system and cladding for the flue, but are awaiting further information from the council before we decide on our next steps.

"In the meantime the shop will continue to operate as normal as we do not wish to make our staff redundant, nor stop providing our healthy meals to our loyal customers, who have been very supportive through this difficult stage in our start up, and we are very thankful to them and the community who have welcomed us."

I'm quite sure the council have adequate powers to shut the place down if they so desire. - To not do so makes a mockery of planning laws doesn't it? :lol:

Noodle bar still open without planning permission after nine months

A Coventry noodle bar remains open without planning permission.

Chop and Wok in Humber Avenue was initially refused planning permission on August 21, 2018 - but opened for business 10 days later.

It was understood that the takeaway - offering a "pan-Asian wok-based" menu of rice and noodle dishes was allowed to trade while they appealed the council's decision to refuse planning permission.

However, the verdict on the appeal was reached in January, and their proposal to turn the site of a former corner shop into a hot food takeaway was again refused.

But once again, Chop and Wok continued to trade.

Nine months on, this remains the case - and they have yet to have a food hygiene inspection.

And Coventry City Council , who were investigating the outlet, served them with an Enforcement Notice in early February, claiming that they were in breach of planning rules.

It has emerged that the reason that they have been able to continue to operate, despite the council enforcement notice - because its owners have appealed to the Planning Inspectorate - a government branch which makes decisions and recommendations on planning issues across England and Wales.

The Planning Inspectorate has confirmed that they have received two valid appeals - one for the refusal of the planning application , and the other against the enforcement notice.

These appeals are set to be considered together - following the appointment of an inspector.

However, a decision isn't expected until "much later in the year" so, in the meantime, Chop and Wok is expected to continue serving Coventry customers in the meantime.

As for the food hygiene rating, a council spokesperson revealed that Chop and Wok will receive an inspection "as soon as possible".
