No evidence has been offered in the case against Richie and Charlie McDonagh
The case against two men accused of attacking and running over another man has been dropped after the alleged victim refused to attend the trial.
Richie McDonagh and Charlie McDonagh had both been charged with causing grievous bodily harm following an incident in the Camp Hill area of Nuneaton on March 15.
Police were called to Cedar Road, near to the Co-op store, following reports of a collision involving a van and a pedestrian.
Richie McDonagh, 19, of Roselands Avenue, in Henley Green, Coventry, and Charlie McDonagh, 31, of no fixed abode, were arrested soon after and subsequently charged.
They had always denied the attack and were due to stand trial today at Warwick Crown Court.
However, before the trial began, the Crown Prosecution Service revealed it was offering no evidence in the case.
A CPS spokesman said: “The complainant and other key witness withdrew their support and refused to attend the trial.
“Without their evidence there was insufficient evidence for a realistic prospect of conviction.”
Now both Charlie and Richie McDonagh will be freed.
Following the incident in Camp Hill on March 15, a man in his 20s was taken to University Hospital in Coventry with suspected fractures to his wrist and ankle, and was later discharged.
That was the second incident in that part of the street in the space of a week and the third over a few months. Methinks they may have been connected?
