West Midlands Police officer sacked for 'racist' comments...

The decision of a tribunal not to dismiss a West Midlands Police officer who made racist comments about his colleages has been overturned.

The officer, who has not been identified due to the nature of his work but known as Officer A, had previously been allowed to keep his job when he appeared before an independent tribunal and was found guilty of gross misconduct in September last year.

He had then been given a final written warning, but after West Midlands Police appealed for a judicial review to the High Court - arguinig the panel 'unlawfully' failed to give proper consideration to harm caused by the 'proven racist comments' on BAME officers - he has now been dismissed from the force by a new panel.

The force also argued the oiginal tribunal had given too much weight to mitigation, including claims Officer A was 'provoked' into making the comments and that he was stressed

The tribunal in September was told the undercover cop had been recorded using racial stereotypes and mimicking the accents of BAME co-workers in his unit, reports BirminghamLive.

The force successfully challenged the panel's decision, resulting in a further hearing yesterday (July 9).

The tribunal in September heard Officer A had joined the force in 2003 and had received commendations for his work.

But he was accidentally recorded talking to ‘Officer B’ about BAME colleagues on a phone left at the unit by another cop.

He had complained colleagues “did not always speak English” in the office and mimicked an Asian accent.

He had also said: “...take this as a racist f***ing comment if you like I don’t care mate. When they start moving in streets they all live together. They don’t want f***ing amalgamating, mix with other people. When they work together, they don’t want to work, mix.”

He had added: “They’ll form their own clan. Them pair did it straight away. Now they’ll do it. When the next one comes in mate they’ll do it.”

The panel had then concluded his words "were racially inappropriate and offensive as alleged".

They also said his mimicking of an Asian accent, in the context of the other commes, was racist behaviour.

But it took into account mitigation, including that he had “not intended to cause offence to any individuals (and) had believed he was speaking in private".

The tribunal in September said it was not satisfied Officer A was "a racist".

It added that an "abundance" of character evidence confirmed he had "always been friendly and supportive to colleagues of all ethnic backgrounds" and had "worked well in a diverse force serving a diverse community".

Officer B was also found guilty of gross misconduct for failing to challenge or report the remarks of Officer A. He also received a final written warning.

Yeah! :roll:

Sacked for speaking the truth as he saw it. What he said doesn't amount to racism to my mind, though his language was a little 'ripe'.
Of course it'll fit; you just need a bigger hammer.

This is widely done in government run places while giving special privileges to their own kind which a white person would be denied because its against the rules.
EG some one I know went on a government training course on the Foleshill Rd he was denied the job course he chose when he asked his Asian boss after finishing the course he did nt want could he now go on the first course he chose he was told he could only go on one which that was it what he had done knowing their language he over heard his boss offering another Asian lad a 2nd course but told him not to mention it to others as its against the rules.

They do the same in shops which I personally find it very rude in front of customers so I now boycotte these places perhaps a law should be passed only English spoken especially in government run places or we learn to speak a new made up language like one of my daughters has done also many in Yorkshire has done and see what happens then.

If you cant beat them join them is my motto. Whats good for the goose is good for the gander.

I sentiment I wholeheartedly agree with, except in many cases these days you'll find yourself on the wrong side of the law. All I ever want is a level playing field: but as a straight, white, Christian, male, I don't often see one.

I agree with you Rebbonk but I doubt if a level playing field will ever happen .
