Tile Hill kebab shop granted late night licence despite objections

Premises given green light to operate until 4am each day

A Coventry kebab shop can stay open until 4am after an extended hours licence was granted by city councillors. Three neighbours had objected to the application from Kebab Express in Tile Hill Road [sic] with a ward councillor also speaking out against the plan.

But the applicant, Amanj Mahmood, whose family own a number of food premises in the city, was told at a licensing sub-committee hearing this week that he would be given permission to stay open until the early hours because neither the police nor the environmental health team had concerns. The outcome means the premises can now open from 12noon to 4am each day.

Cllr Marcus Lapsa, who represents the Westwood ward, was unable to attend the hearing but his statement was read out. He explained that his objections were on behalf of several local residents who had expressed serious concerns about the potential impact granting the extended hours licence would have on their community.

The statement said: “Local residents have raised consistent issues around noise nuisance and anti-social behaviour associated with late night trading in the area. There are already ongoing disturbances during the current operating hours and extending these hours would likely worsen the situation, affecting the peace and wellbeing of nearby residents.

“Concerns include loud conversations, shouting, littering and general disruption during the early hours of the morning. I respectfully request that the committee consider the strong local objections to this application and the potential negative impact and extension of hours would have on community safety, comfort and cohesion.”

Cllr Lapsa added that some residents had said that the application had not been adequately advertised meaning that a number were unaware of the opportunity to comment until late in the process and that some of the comments had been discounted. But the committee of three councillors were unconvinced. Cllr Faye Abbott, who chaired the hearing, asked if there had been complaints made about the premises which had only been open for around a month.

Rekah Masis, the council’s licensing team leader, said there had been no feedback from environmental protection and that some of the comments made by members of the public were not valid as they referred to parking and traffic which were outside of the licensing panel’s remit.

In approving the extended hours licence, Cllr Abbott said: “In reaching the decision, the committee considered the application on its own merits. We attached the appropriate weight to the fact that no responsible authorities who are considered experts in their individual fields, objected to the application.

“In particular, the sub-committee considered the Licensing Act 2003 which states that the police should make representations where there are concerns about crime and disorder. Likewise it is reasonable to expect that a local authority exercising an environmental health function make representations where there are concerns about noise nuisance. Neither the police nor environmental health have objected or raised concerns around this application.

“The sub-committee sympathise with objectors and concerns raised about the premises being allowed to operate until 4am. However, in lights of the operating schedule and the explanations given during the hearing, the sub-committee considered that the applicant had shown willingness to take steps to address, as far as possible, problems arising from the premises.”

Part of the old Standard Cinema in Tile Hill Lane if I'm not mistaken?

Was "Top Burger" until recently.
